When hiring US-based is the right call

Hire in the US when the engineer needs to be in the room, even a virtual one. That means anyone owning a product surface where requirements are still moving, anyone who will be on call for a US-hours incident rotation, anyone customer-facing, and your first two or three engineers, whose judgment sets the technical culture everyone hired after them inherits.

It also matters when the work touches regulated data. If your product handles protected health information, financial account data or federal contract work, the location of the person with production access is a compliance question and not just a cost one. Some customer contracts require US-based personnel outright, and discovering that during a security review after you have staffed the team offshore is an expensive way to learn it.

Go the other way when the work is genuinely modular. A well-specified integration, a defined migration, a mobile app built to a finished design, or extra capacity on a mature codebase with good tests and clear conventions all survive a time-zone gap fine. Two risks are worth naming plainly, because they are the ones that turn into invoices later. The first is worker classification. The IRS applies a control test with three factors, behavioral control, financial control and the type of relationship, and calling a full-time engineer a contractor to skip payroll obligations does not change the answer. The second is permanent establishment. If a person abroad effectively represents your business in that country, tax authorities can treat you as having a taxable presence there, and enforcement has been widening to cover people who drive business outcomes locally without formally signing contracts.
